Terms & Conditions

 

1. Booking & Payment

A signed agreement and a non-refundable retainer fee are required to secure your booking date. No session or event date is reserved until both are received.

The remaining balance must be paid in full prior to the scheduled session or event date unless otherwise agreed upon in writing. Payments are accepted through our approved booking system only, please note we do NOT accept payment in the form of check.


By submitting any form of payment to 818 Films Photography, you acknowledge and agree to these Terms & Conditions in full. Payment for services constitutes acceptance of this agreement, regardless of whether a contract has been signed. In the event that a formal contract is not provided or executed, full or partial payment for services still binds the client to all Terms & Conditions outlined herein.

2. Cancellations, Rescheduling & No-Shows

Retainer fees are non-refundable.

Clients may request to reschedule one time with at least 48 hours’ notice, subject to availability.

Failure to provide adequate notice or failure to attend the scheduled session or event (no-show) will result in forfeiture of all payments made. No-shows are not eligible for rescheduling under any circumstances.

3. Turnaround Time

Photo delivery timelines vary depending on the service:

  • Portrait sessions: typically delivered within 7–14 business days
  • Events & weddings: typically delivered within 3–6 weeks

Delays may occur during peak seasons, but we always strive to deliver as quickly as possible without compromising quality.

4. IMAGE DELIVERY

All final images will be delivered via an online gallery. Clients are responsible for downloading and saving their images within the provided timeframe.


Raw/unedited images are not included and will not be delivered.

5. EDITING & CREATIVE STYLE

By booking with 818 Films Photography, you acknowledge and agree to our editing style and creative direction. This includes color grading, cropping, and overall artistic decisions.

Additional edits beyond the delivered gallery may be subject to extra fees.

6. USAGE & COPYRIGHT

818 Films Photography retains full copyright of all images.


Clients are granted personal use rights, which include:

  • Sharing on social media
  • Printing for personal use


Images may not be altered, sold, or used for commercial purposes without written permission.

We reserve the right to use images for portfolio, website, and promotional purposes unless otherwise requested in writing.

7. SESSION EXPECTATIONS

Clients are responsible for arriving on time. Late arrivals may result in reduced session time.

For outdoor sessions, lighting and weather conditions may impact the outcome. We will do our best to adapt, but results may vary.


A 10-minute grace period is allowed for all scheduled sessions. After 10 minutes, the session may be shortened or considered a no-show at the photographer’s discretion.

8. CLIENT COOPERATION

Clients agree to cooperate and follow the direction of the photographer to achieve the best possible results. 818 Films Photography is not responsible for missed images due to lack of cooperation, lateness, interference from guests, or failure to follow agreed timelines.

For events and group sessions, the client is responsible for ensuring all necessary participants are present and ready at the scheduled time.

9. LATE PAYMENTS

Any payments not received by the agreed due date may be subject to a late fee. 818 Films Photography reserves the right to:

  • Delay delivery of images
  • Withhold galleries
  • Cancel services without refund

Until the outstanding balance is paid in full.

10. CHARGEBACKS & PAYMENT DISPUTES

By submitting payment, the client agrees not to initiate any chargebacks or payment disputes without first contacting 818 Films Photography to resolve the matter.

Any chargeback initiated without prior communication will be considered a breach of this agreement.


The client agrees to be responsible for:

  • The full service amount
  • Any time spent resolving the dispute
  • Associated fees, including administrative and legal costs

818 Films Photography reserves the right to provide proof of agreement, including this Terms & Conditions page, booking confirmations, and delivered work, in response to any dispute.

11. LIABILITY

818 Films Photography is not responsible for:

  • Uncooperative subjects (including children)
  • Missed shots due to client delays or restrictions
  • Weather conditions or unforeseen circumstances beyond our control

In the unlikely event of equipment failure or other issues, liability is limited to a refund of payments made.

12. MODEL RELEASE

By booking, clients grant permission for 818 Films Photography to use images for marketing and promotional purposes unless a written request is submitted prior to the session.

13. AGREEMENT

By booking or submitting payment to 818 Films Photography, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. This applies whether or not a formal contract has been signed.
